Apple today received a letter from NASDAQ notifying the company that it is incompliant with the tech stock exchange rules, and has requested a hearing before the NASDAQ Listing Qualifications Panel in response. "As anticipated, the letter was issued in accordance with NASDAQ procedures due to the delayed filing of the Company's Form 10-Q for the quarter ended July 1, 2006," Apple wrote. "Pending a decision by the Panel, Apple shares will remain listed on the NASDAQ Stock Market."

A new shareholder derivative complaint has been filed against Apple, following the company's recent announcement that it has found additional stock irregularities.
Keller Rohrback L.L.P. today announced that a shareholder derivative complaint has been filed in the United States District Court for the Northern District of California on behalf of nominal defendant Apple and against certain Company executives and board members.

Apple said an internal investigation discovered irregularities related to the issuance of certain stock option grants made between 1997 and 2001.
A special committee of Apple's outside directors has hired independent counsel to perform an investigation, and the Company has informed the SEC.
